Posts: 23 ( 4-Jul-09 11:28 AM) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	Tags : None Hey all, i was riding home yesterday (friday 3/6/09), and the roaring southerly definately made it a cold blustery ride. Crossing the captain cook bridge at about 415, i copped a blast of wind from the side, and literally got pushed into the right hand lane! The poor tradie who was slightly behind me in the right hand lane screeched to a halt to avoid me. Thankfully he avoided hitting me. Same cant be said for the little pantech following him. Both ute and truck suffered minor damage. GTR unscathed. We swapped details etc and have decided to let the insurance companies sort it out. Im not too sure where i stand here, as being literally blown sideways may or may not be construed as my fault? I guess at the end of the day i MAY have an excess to pay, but it will be interesting to see how it goes. The lovely lass at InsureMyRide seemed to think if the incident was reasonably deemed to be not my fault, then it just becomes an issue between the two other drivers. One waits to see.... Regards Dan

Someone crashed into it, but he had to wear some percentage of the blame, account his car was there, and involved. Go figure,......... but that was a long time ago, and things change, but something that never changes is the fact that insurance companies don't like to pay up. Oh!! the stories one could tell. Remember this one...Shss he's/she's/it's/ ( dam political correctness ) sleeping. But full kudos for stopping, in this day and ago, it renews your hope. ( seen the news lately ) Honesty, accountability, and just plain doing the right thing ,...............should be rewarded!! Oh, and thank someone, that the tradie had good reflexes, or your arse would be toast. Hope you post the results of this incident, would like to know the outcome. David Adelaide. GTR 1000

Posts: 26 ( 7-Jul-09 10:56 AM) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	A wee update, I contacted the insurer of the ute (RACQ) and the claims officer there said that at this stage they are holding the pantech driver at fault for the collision. So i guess that leaves me in the clear. However, and interesting point to note is that according to RACQ, in some instances, they still apportion blame in some cases of nose to rear collisions. Ie the vehicle following too closely may be apportioned 80% at fault, while the car in front may be 20% etc etc....depending on the circumstances. Something about ensuring that you leave sufficient braking distance between you and a following vehicle. Its all a bit beyond me really.

He was following a car in the right lane leaving a safe distance between him and the car in front. Another car took the space as the traffic was slowing down fast. He hit the car that had cut in front. Police verdict was "car was wholly within your lane. You hit it, your fault." Possibly unfair but I guess a "line" has to be drawn.
